Documenting this Fight for Trans Civil Rights: An Impactful Documentary Reveals the Human Story

Trans filmmaker Sam Feder's newest film "Heightened Scrutiny" presents a moving dual viewpoint – simultaneously an personal profile of a leading trans activist and a sharp analysis of journalistic coverage about trans rights.

Legal Struggle at the Supreme Court

This feature traces ACLU lawyer Chase Strangio as he gets ready for court proceedings in the landmark Supreme Court case US v Skirmetti. These arguments happened in late 2024, with the court eventually deciding in favor of Tennessee's argument, effectively permitting restrictions on medical transition for transgender youth to stay in effect across over twenty US states.

We created Heightened Scrutiny in merely 16 months, stated Feder during a discussion. Meanwhile, my earlier film Disclosure took me five years, so this was a real push. Our goal was to generate conversation so people would know more about the case.

Human Narrative Amid Legal Struggle

Although Feder offers a comprehensive analysis of how mainstream publications have promoted anti-trans rhetoric, the film's primary accomplishment may be its engaging portrayal of Strangio. Normally a measured lawyer in media settings, Strangio displays his authenticity throughout the production.

This represented a substantial challenge, to reveal parts of my life to a filmmaker that I had worked hard to keep confidential, shared Strangio. Sam said he wanted future generations to know that we struggled, to see what was done in defense of these battles for our basic existence.

Diverse Voices in the Movement

To strengthen Strangio's story, Feder includes multiple trans activists, such as well-known individuals from media and entertainment. The documentary also includes insights from non-trans supporters who critique how mainstream media outlets have added to damaging reporting of transgender individuals.

The perspective of trans youth central to the legal case is illustrated through a remarkable young activist named Mila. Viewers first see her fighting for her community at a school board meeting, with later scenes showing her protesting for transgender rights outside the Supreme Court.

Intimate Moments Beyond the Courtroom

This film also contains emotional moments where Feder transcends the constant political struggle, such as footage of Strangio vacationing in Italy and receiving a tattoo featuring verses from activist Pauli Murray's poem "Vision."

This body art moment is among my most cherished sections in the movie, stated Strangio. Being tattooed is almost like a contemplative experience for me, to be completely aware in my body and to consider it as a vessel for things that are meaningful to me.

Body Identity and Portrayal

Feder's attention to thoughtfully showing Strangio getting to his tattoo collection highlights that Heightened Scrutiny is primarily about trans physical selves – not just those of young people who face restriction of their ability to live genuinely in their own bodies, but also the bodies of the various interviewees who participate in the production.

I make films with a message, and part of that is picking people who are outstanding and eloquent enough to hold the camera, explained Feder. When people ask me what they should wear for an filming, my reply is whatever makes you feel attractive. That is crucial to me – as transgender individuals, we have difficulties so much with our self-perception.

Impact and Optimism

One aspect that makes Feder's documentaries stand out is his evident ability for making his trans participants feel at ease, acknowledged and admired. This methodology creates genuine rapport between Feder and Strangio, helping the director to realize his objective of portraying Strangio as a multifaceted individual and leaving a testament for posterity of how determinedly he and others have struggled for trans rights.

I hope not people to find themselves in a situation of constant discouragement because of what the law is denying us, explained Strangio. I aim to be in a practice of using the law to lessen harm, but not to make it some sort of conduit for our liberatory potential. State bodies is not going to be the mirror through which we see ourselves. We are that reflection, and it's really crucial that we continue having that conversation alongside conversations about fighting back these laws and practices.
